Artists Terms & Conditions of Use

1. Introduction
By submitting artwork to Artfully Curated (“Artfully Curated”, “we”, “our”, or “us”), you (“the Artist”) agree to the following Terms and Conditions regarding the submission, reproduction, promotion, and sale of your artwork through our platform and associated promotional channels.
2. Eligibility and Artist Responsibilities
To participate, the Artist must:
- be at least 18 years old;
- be the legal creator and copyright owner of the submitted artwork;
- have full authority to submit the artwork and grant the rights outlined in these Terms.
The Artist is solely responsible for ensuring that all submitted artwork:
- is original;
- does not infringe any copyright, trademark, privacy, moral rights, or other third-party rights;
- complies with applicable laws and regulations.
The Artist agrees to act professionally and provide high-quality, print-ready files suitable for reproduction.
Artfully Curated reserves the right to request replacement files or additional information where necessary.
3. Intellectual Property & Usage Rights
The Artist retains full intellectual property rights over their submitted artwork.
By submitting artwork to Artfully Curated, the Artist grants Artfully Curated a non-exclusive, worldwide, royalty-free licence to:
- reproduce, print, display, publish, distribute, and promote the artwork;
- use the artwork across digital and physical marketing channels;
- display the artwork online, on social media, in editorial features, printed promotional materials, exhibitions, galleries, pop-up spaces, partner venues, and other promotional settings;
- reproduce the artwork for the sale and fulfilment of prints and related products;
- share artwork files with trusted printing, production, fulfilment, and promotional partners where reasonably required for business operations.
This licence is granted solely for the purposes of operating, promoting, marketing, and selling artwork through Artfully Curated.
This agreement is non-exclusive, and the Artist remains free to sell or license their artwork elsewhere.
4. Artist Warranty and Indemnity
The Artist confirms that:
- they are the sole creator and copyright owner of the submitted artwork;
- the artwork does not infringe any third-party rights;
- they have full authority to grant the rights outlined in these Terms and Conditions.
The Artist agrees to indemnify and hold harmless Artfully Curated, its directors, employees, partners, and affiliates against any claims, damages, liabilities, legal costs, or expenses arising from:
- copyright infringement;
- intellectual property disputes;
- breach of these Terms;
- or any unlawful or unauthorised submission of artwork.
5. Pricing Models
Artists may choose one of the following pricing approaches:
Option 1 — Set Your Earnings
The Artist specifies how much they wish to receive per print sale.
Artfully Curated will then add:
- print production costs;
- applicable payment processing fees;
- and a 25% commission
to determine the final retail price shown to customers.
Option 2 — Set the Retail Price
The Artist specifies the final retail price shown to customers.
This retail price must include:
- print production costs;
- applicable payment processing fees;
- and Artfully Curated’s 25% commission.
6. Commission and Fees
Artfully Curated retains a 25% commission on all sales to cover curation, marketing, platform management, and operational costs.
Print production costs are deducted from the retail price and may vary depending on size, framing, and format.
Payment processing fees charged by third-party providers (such as Stripe or PayPal) may also apply.
Artfully Curated reserves the right to amend production costs where necessary. Artists will be notified of material pricing changes.
7. Payments
Artist payments are issued monthly within 30 days of the end of each calendar month for eligible completed sales.
Payments are made via the payment method selected by the Artist, such as:
- bank transfer;
- PayPal;
- or other approved payment providers.
A minimum payout threshold may apply.
Artfully Curated reserves the right to withhold payments where:
- fraudulent activity is suspected;
- refunds or chargebacks are pending;
- or the Artist is in breach of these Terms.
8. Artwork Quality and Reproduction
The Artist is responsible for providing high-resolution files suitable for professional print reproduction.
Artfully Curated may make minor adjustments to submitted files where necessary, including:
- cropping;
- resizing;
- colour calibration;
- or formatting adjustments
to ensure consistency in presentation and print quality.
While reasonable efforts will be made to accurately reproduce artwork colours and details, slight variations may occur between digital previews and printed products.
9. Artwork Rejection and Removal
Artfully Curated reserves the right to reject, suspend, or remove artwork at its sole discretion.
Reasons may include, but are not limited to:
- quality concerns;
- copyright or ownership disputes;
- offensive or inappropriate subject matter;
- breach of these Terms;
- or content deemed inconsistent with the brand, values, or curatorial direction of Artfully Curated.
10. Copyright Infringement and Takedown Policy
If Artfully Curated receives notice of potential copyright infringement or unauthorised use, we reserve the right to temporarily suspend the artwork from sale or display while the matter is investigated.
If infringement is confirmed, the artwork may be permanently removed without notice.
The Artist remains solely responsible for any legal consequences arising from copyright violations or unauthorised submissions.
11. Marketing and Promotional Use
The Artist agrees that Artfully Curated may use the Artist’s:
- name;
- biography;
- social media information;
- and images of their artwork
for promotional and commercial purposes.
This may include use across:
- websites;
- social media;
- email marketing;
- editorial content;
- printed promotional materials;
- exhibitions;
- gallery displays;
- pop-up events;
- partner venues;
- press features;
- advertising campaigns;
- and other promotional channels.
This helps promote both the Artist and their work.
12. Returns, Refunds, and Customer Service
Artfully Curated manages all customer service, returns, and refund requests.
If a refund, cancellation, or chargeback is issued for an order, the Artist will not receive earnings relating to that sale.
Artfully Curated reserves the right to determine appropriate resolutions for customer complaints, damaged deliveries, or production issues.
13. Limitation of Liability
Artfully Curated shall not be liable for:
- indirect or consequential losses;
- loss of profits, reputation, opportunity, or anticipated sales;
- technical issues;
- website downtime;
- shipping delays;
- third-party service failures;
- or printing or fulfilment errors outside our reasonable control.
Artfully Curated’s total liability relating to any claim shall not exceed the total commission earned by Artfully Curated from the relevant artwork sale.
Nothing in these Terms excludes liability that cannot legally be excluded under the laws of England and Wales.
14. Taxes and VAT
Artfully Curated is a trading name of Artfully Promoted, a VAT-registered company.
VAT will be applied where required in accordance with UK tax law.
If the Artist is VAT-registered, they must provide a valid VAT number and any information reasonably required for invoicing or compliance purposes.
The Artist remains solely responsible for:
- reporting their income;
- accounting for VAT where applicable;
- and complying with their local tax obligations.
Artfully Curated may provide payment summaries or statements to assist with tax reporting.
15. Force Majeure
Artfully Curated shall not be liable for delays or failures caused by events outside its reasonable control, including but not limited to:
- natural disasters;
- pandemics;
- strikes;
- internet outages;
- supply chain disruptions;
- governmental restrictions;
- or failures of third-party services.
16. Termination
Either party may terminate this agreement at any time by providing written notice.
Upon termination:
- future sales of the Artist’s work will cease within a reasonable timeframe;
- active promotional use of the artwork will stop where reasonably practical.
However, previously published:
- social media posts;
- editorial features;
- printed promotional materials;
- archived website content;
- and transactional records
may remain in circulation or archived where removal is not reasonably possible.
17. Amendments
Artfully Curated reserves the right to update or amend these Terms and Conditions periodically.
Artists will be notified of any material changes where appropriate.
Continued use of the platform following updates constitutes acceptance of the revised Terms.
18. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
